Jurisdictional Applicability & Compliance Framework
In accordance with 8 CFR Β§ 217 β Visa Waiver Program Regulations
5.1 β Scope of Authorisation
An approved ESTA does not constitute a visa and does not confer any legal right to admission into the United States. It is a pre-screening mechanism that determines preliminary eligibility. The final determination of admissibility is rendered by a U.S. Customs and Border Protection officer at the port of entry.
5.2 β Validity Parameters
- Authorisation validity: two (2) years from date of approval, or until passport expiration, whichever is earlier
- Maximum duration per entry: ninety (90) calendar days
- Multiple entries permitted within the validity period
- Not extendable or convertible to another immigration status
5.3 β Grounds for Revocation
A previously approved ESTA may be revoked under the following circumstances, as determined by the adjudicating authority:
Change in the Applicant's criminal history or immigration record
Overstay of a prior authorised admission period
Modification of VWP country designation affecting the Applicant's nationality
Discovery of material misrepresentation in the original declaration
Issuance of a new passport invalidating the linked travel document
[OFFICIAL ADVISORY]
Revocation of authorisation credentials is effective immediately upon determination. The affected Subject shall be notified via the registered correspondence address. Continued travel on revoked credentials constitutes a violation of immigration law.
